Fee Deposit Permit Number

The St. Clair County Drain Commissioner, Fred Fuller, first party, under authority granted by the Drain Code of 1956, does hereby consent to the construction, installation, operation and maintenance by , second party, of a , herein called a facility, in on, under, through or across the Drain, located in the Township/City/Village of , St. Clair County, Michigan on the following terms and conditions:

1. The facility shall be constructed at the location, elevation, and manner shown in the attached drawing and which drawing is made part of this agreement. All underground lines must be buried a minimum of 5 feet below existing bottom and side slopes of drain unless a written agreement is reached between both parties stating otherwise.
2. All work done in connection with said construction shall be done in a responsible manner, and said drain shall be left in as good condition and as near the same contour as possible upon completion of said construction as existed prior hereto.
3. Drainage shall be maintained and left unobstructed during construction so as to prevent the backing up of water which would cause flooding of adjacent land.
4. Second party agrees to assume all liability for any loss or damage sustained by any person or property as a result of operations performed under this agreement and further agrees to repair any damage which it might cause to said drain as a result of the construction herein described.
5. Second party agrees to furnish and install permanent facility location markers as shown on the attached drawing.
6. Second party agrees to notify first party 48 hours prior to the commencement of work herein described, so, if decided necessary by the first party, an inspector can be present while the work is in progress and second party agrees to pay the necessary expense of first party’s inspector.
7. It is the responsibility of the second party to secure any additional permits from pertinent local, state and federal agencies as required prior to the commencement of construction of said crossing.
